SOLFORM

Terms of Service & Client Liability Waiver

Effective date: October 28, 2026 · SOL FORM LLC · Miami, Florida

1. Who we are and when these terms apply

SOL FORM LLC, doing business as SOLFORM ("SOLFORM," "we," "us"), operates fitness instruction and studio services at the address below. These terms cover our website, studio services, private lessons, class bookings, and SOLFORM booking experiences provided through Mariana Tek when available. Our Privacy Policy explains information handling.

Review these terms before making a purchase or reservation. Purchase-specific terms disclosed and accepted at checkout also apply. A separate signed membership agreement governs its specific price, duration, renewal, and payment obligations. Mandatory consumer rights take priority over conflicting terms. Browsing this page alone does not sign the participation waiver below or authorize charges.

Schedules, memberships, booking features, and app availability may be announced before launch. An informational listing does not confirm that a service is available for purchase.

2. Accounts, eligibility, and studio conduct

Provide accurate account and emergency-contact details, keep sign-in credentials secure, and notify us of unauthorized activity. You must be at least 18 to enter a purchase or membership agreement independently. A parent or legal guardian must contact the studio before arranging participation by anyone under 18; admission is subject to studio approval and a separately completed guardian process. No minor should book or sign an adult waiver independently.

Follow instructor directions and use equipment only as authorized during instruction. Grip socks are required on reformers; appropriate running shoes are required for treadmill use. The front desk confirms grip socks even if you use mobile check-in. Arrive 15 minutes early for your first visit and 5–10 minutes early thereafter. Unsafe conduct, harassment, impairment, or misuse of equipment may result in refusal of participation. Any cancellation or refund rights remain applicable.

3. Booking, machines, and waitlists

Our class names are SolForm 50: Incline and SolForm 50: Intervals. Private Sessions are offered through appointments when available. The standard booking window opens on a rolling 7-day basis. Founding 50 members receive rolling 8-day access; if the booking system cannot support that distinction, contact the front desk for priority booking assistance.

You may hold up to 5 future class reservations at a time. Unlimited and Founding 50 memberships permit one class per day. The room has 16 starting positions: Reformer 1–8 and Treadmill 1–8. A spot selection identifies the machine on which you start; participants switch during class. You may change available spots until one hour before class. ClassPass reservations receive an available assigned spot rather than spot-selection privileges.

Waitlists are limited to 8 people. Automatic promotion may occur until 2 hours before class. Joining a waitlist authorizes a reservation and use of the applicable credit if you are promoted during that window. Remove yourself if you can no longer attend. Monitor your account and notifications; the cancellation policy applies after promotion. Last-minute Quickfill invitations, when enabled and consented to, require the booking or acceptance described in that invitation; a text invitation alone is not a confirmed booking. There is no standby queue.

Standard online booking, mobile check-in, and applicable waitlist sign-up cutoffs are 5 minutes before class. These cutoffs do not guarantee late entry. The booking confirmation and front desk identify any appointment-specific requirements. ClassPass bookings are also governed by ClassPass's applicable terms; contact the studio if platform policies conflict.

4. Late cancellations, no-shows, and private appointments

Private appointmentsAt least 24 hours before startSee appointment's disclosed termsSee appointment's disclosed terms

For class packs and drop-ins, a late cancellation or no-show also forfeits the class credit. Membership clients incur the applicable class fee. A single missed reservation is subject to either the late-cancellation fee or the no-show fee, not both. Fees must be disclosed and accepted before booking and charged only under a valid payment authorization. The class fees above do not establish a separate private-appointment penalty; any private-session forfeiture or fee must be disclosed before purchase or booking.

Cancel individual classes through your booking account when available or contact the front desk. If the system is unavailable, email us promptly with the reservation details; we use the time we receive the request. Keep the cancellation confirmation. If SOLFORM cancels your session, no late fee applies and the credit is restored; contact us about an appropriate refund or alternative when required. Statutory rights below override these rules.

5. Purchases, memberships, and refunds

The purchase screen and your agreement must show the full price, applicable taxes, included services, expiration, minimum commitment, billing frequency, renewal terms, and cancellation instructions before you pay. A saved card alone is not consent to a new recurring plan. Recurring charges require your express authorization. We do not change an existing committed price or impose a new fee retroactively without the notice and consent required by law.

The advertised Founding 50 offer is limited to 50 memberships with a 12-month commitment. Other advertised plans may have different commitments. A five-session private pack is advertised at $700; its purchase confirmation specifies validity and appointment terms. Review the particular offer rather than assuming all plans have the same conditions. Pre-opening purchases must have a separate written agreement identifying when services begin and any applicable pre-opening protections.

To request membership cancellation or ask about a freeze, email info@solform.fit or contact the front desk. Include your name and account email, but never email full card details. We will confirm the effective date and any lawful remaining obligations under your agreement. Routine cancellation does not automatically waive a disclosed minimum term, but no minimum term restricts mandatory cancellation rights. Where law requires an online cancellation method for an online subscription, that method must also be provided; front-desk contact is not a substitute for a legally required method.

Unused credits, refunds, and transfers follow the specific accepted offer and applicable law. There is no blanket exclusion of statutory refunds. Gift cards are applied toward eligible purchases; any taxes are applied to the underlying purchase. Gift-card expiration, fees, and cash redemption are subject to applicable law.

6. Florida health-studio consumer rights

Applicable Florida health-studio protections override conflicting purchase terms. Qualifying contracts may be canceled without penalty within 3 days, excluding weekends and holidays, by written notice mailed or delivered to the studio; legally permitted deductions for services already provided may apply. Required refunds are issued within 30 days of receiving notice. Qualifying closure, relocation, death, or disability can also create cancellation and prorated refund rights. Contact the Florida Department of Agriculture and Consumer Services within 60 days if the studio closes.

Your signed agreement must include the applicable statutory disclosures, refund calculations, and cancellation provisions near your signature. This website does not replace those contract requirements. See Florida Statutes section 501.017 and contact us to exercise a right. Written notices may be mailed or delivered to our address below; we also accept cancellation requests by email.

7. Client assumption of risk & liability waiver

READ CAREFULLY. THIS SECTION AFFECTS LEGAL RIGHTS. AN ADULT PARTICIPANT MUST SEPARATELY ACKNOWLEDGE AND SIGN THIS WAIVER BEFORE PARTICIPATING.

Activities and inherent risks

Reformer Pilates, treadmill walking and running, intervals, strength exercises, private lessons, stretching, and use of studio facilities involve physical exertion and risks. These include falls; moving belts, springs, straps, and carriage mechanisms; loss of balance; collisions; strains and fractures; aggravation of existing conditions; cardiovascular events; illness; and, in serious cases, permanent disability or death. Risks may arise from equipment, the premises, other participants, my actions, or failure to follow directions. Instruction and supervision cannot eliminate every risk.

Personal responsibility and voluntary participation

I choose to participate voluntarily and assume the inherent risks to the extent permitted by law. I will seek medical advice when appropriate, disclose limitations that affect safe participation directly to my instructor, follow safety instructions, and stop immediately if I experience pain, dizziness, breathing difficulties, or unsafe conditions. SOLFORM provides fitness instruction, not medical care or diagnosis. I am not relying on a promise of a particular health or fitness result.

Release of ordinary-negligence claims

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, I RELEASE SOL FORM LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND INSTRUCTORS FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION OR USE OF THE STUDIO, INCLUDING CLAIMS CAUSED BY THEIR ORDINARY NEGLIGENCE IN INSTRUCTION, SUPERVISION, EQUIPMENT MAINTENANCE, OR THE CONDITION OF THE PREMISES.

This release does not cover gross negligence, reckless or intentional misconduct, or any liability or right that cannot legally be released. It does not waive statutory membership cancellation or refund rights. It does not release another person's independent rights. If a provision is unenforceable, it is limited or severed only to the extent permitted by law.

Emergency assistance and acknowledgment

If I cannot respond during an emergency, I authorize staff to contact emergency services and my emergency contact. This does not authorize non-emergency treatment or limit my rights concerning medical care. I remain responsible for charges lawfully owed to medical providers. I understand that personal belongings are brought at my own risk, subject to liability that cannot lawfully be excluded.

By separately signing this waiver, I confirm that I am 18 or older, have read and understood it, have had the opportunity to ask questions, and voluntarily agree. My signed record must identify my full name, date, and signature or affirmative electronic acknowledgment. A minor's participation requires a separate guardian process and any legally required minor-specific waiver; this adult waiver is not presented as a substitute. No promotional photo or video permission is granted by this waiver.

8. Communications and third-party booking services

Booking confirmations, schedule changes, receipts, waitlist notices, and account messages may be sent through the channels you authorize. Promotional email and text choices are separate from accepting these terms. Marketing texts require a separate affirmative opt-in where required; consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out of texts or HELP for assistance; you may also contact us. Email marketing includes an unsubscribe option. Opting out may prevent text-based Quickfill notifications, but does not cancel a reservation.

Mariana Tek and payment providers facilitate services when enabled. Their own applicable terms and privacy notices may also apply. SOLFORM remains your contact for studio purchases, refunds, and service issues. Do not use our systems to abuse others, interfere with security, scrape private data, or misrepresent your identity.

9. Website content, disputes, and updates

Our branding, photographs, and website content are protected by applicable intellectual-property laws. You may use the site for personal information and authorized bookings, not reproduce it commercially without permission. Service availability may be interrupted; contact the studio if you cannot manage a time-sensitive reservation. Nothing here excludes nonwaivable warranties or remedies.

Florida law governs to the extent permitted by applicable law. Contact us first to try to resolve a concern. These terms do not impose mandatory arbitration or waive your right to bring a claim in an appropriate court. Changes will be dated on this page and communicated when required; material changes to an existing agreement require any consent mandated by law. Contact us for an accessible copy or questions before signing.
